Why Do I Need A U.S. Entry Waiver?

A U.S. Entry Waiver is an entry permit that allows you to travel to the United States without restrictions. You require a U.S. Entry Waiver if you fall into one of the following categories:

  1. You have a criminal record in Canada and thus have been denied entry to the United States, or you simply want to avoid being denied entry.
  2. You have a criminal record in the United States and now live in Canada.

How Do I Apply for a U.S. Entry Waiver

A U.S. Entry Waiver aplication is a complex process that requires the applicant to complete the following steps:

  1. Complete and analyze a nationwide fingerprint search
  2. Complete biographical information (Form G-325A)
  3. Compile and filter police records and court documents for each charge and conviction
  4. Gather and assess several character references
  5. Provide compelling proof of rehabilitation and good conduct
  6. Complete Form I-212 (if you have already been denied entry to the U.S.A.)

Technically speaking, any individual can gather the above criteria and submit their application to the Department of U.S. Homeland Security at  the U.S. border. Unfortunately, most people that attempt this on their own or with an inexperienced company, have their application denied and lose their submission and application fees. This is primarily due to two reasons:

  1. The administrative paperwork has an error. (This error can be as simple as a date that is incorrect by a single digit/day.)
  2. The qualitative part of the application has not met the expectations of the Department of U.S. Homeland Security. The officer at U.S. Homeland Security that reviews your file looks for very specific requirements when reviewing your statements. How long will my waiver last?

The Department of U.S. Homeland Security is the organization in the United States that reviews your U.S. Waiver Application and ultimately decides whether or not to grant you your Waiver. If you are approved, you can receive a Waiver that will be valid for anywhere from six months to five years. Once your Waiver expires, you must submit a new application, and once again pay the processing and submission fee.
